What ails the Indian judiciary? It is a tough question, with no precise answer. The time has come when we should stop beating around the bush and see the real picture.

The track record of the Indian Judiciary since independence is something to be proud of. The judiciary has always played an indispensable role which is beyond comparison. According to the constitution, judiciary has played pivotal role in safeguarding the rights of citizens.

On 6th of May 1993, in Nokhla village of Garhi tehsil, Rao ji alias Ramchandra kills his wife, three children and neighbors. The issue reached district court where he was found guilty and sentenced to death. This incident took place in Banswada district in Rajasthan. Within a period of two and a half years his case reached Supreme Court. He sent mercy petition to Governor of Rajasthan. On 1 January 1996 his plea was rejected. A month later he sent his mercy plea to President. His petition was rejected within three months. In month of May 1996 he was hanged to death. Within three years everything came to an end. In the year 1999 Murugan, Santha and Ariv of Tamilnadu get death penalty. They were found guilty in the murder case of former Prime Minister Rajeev Gandhi and 18 other people.

Perhaps for the first time Indian government is nervous and trapped in few questions asked by Indian army. Our mighty army has refused to fire bullets on the people of their own country. The Information Technology Act, 2000 was introduced on 9th june, 2000. Mitigation that has led to the introduction of the information technology act, 2000 was the model law of electronic known as the United Nation Commission of International Trade Law which was introduced in the general assembly of UN by its resolution No. 51 of 162 dated 30th January, 1997 which has recommended that all the states should give favourable consideration to the said model law which contained equal legal treatment of user of electronic communication and paper based communication.
